Read More A Federal High Court sitting in Apo, Abuja, Nigeria's capital territory, has ordered the freezing of all the monies of the Abia State government domiciled in about 27 commercial banks. Justice Bello Kawu gave the order while ruling on a motion ex parte motion Marked No: M/6686/2023 filed by Mr Uche Eni against the Accountant-General of Abia State and the Commissioner for Finance. In ruling on the motion, the court further barred all the banks from cooperating with the financial aides of Governor Okezie Ikpeazu pending the determination of the motion on notice. Commercial banks listed as Respondents include: Access Bank Plc, Eco Bank Plc, First Bank Plc, Guaranty Trust Bank, Central Bank of Nigeria, Federation Account Allocation Committee (FAAC), Accountant General of the Federation and 21 other financial institutions. The court also granted reliefs sought by the claimant’s lawyer, Johnmary C. Jideobi, among which are: “An order of this Honourable Court freezing forthwith all the monies belonging to the people and Government of Abia State of Nigeria or controlled by the Defendants and domiciled in any Bank (whatsoever named) operating within Nigeria or domiciled with or in the hands of the 1st to 28th Respondents PENDING the hearing and determination of the Motion on Notice filed herein. “An order of this honourable court restraining the 1st to 28th Respondents from co-operating with the 1st and 2nd Defendants or any authority and person purporting to be acting on behalf of or in the name of the Government of Abia State of Nigeria (howsoever named or described) in accessing any funds held by the 1st to 28th Respondents for the benefit of the people and Government of Abia State of Nigeria PENDING the hearing and determination of the motion on notice filed herein. “An order of court granting the Claimant/ Applicant leave to effect a substituted service of all the originating processes in this suit, inclusive of the ex-parte Order of this Court, on the 1st and 2 Defendants at the Abia State Liaison Office, Abia House, Abuja, through any registered post or courier service operating within the Jurisdiction of this honourable Court and for same to be deemed as proper services. “An order restraining the 1st and 2nd defendants forthwith from Interfering with dealing with, withdrawing or accessing in whatever manner, monies in the hand of the 1 to 28th Respondents belonging to the Government and people of Abia State pending the hearing and disposal of the Motion on Notice filed herein. “An interim order of this Honourable Court restraining all the Respondents and their privies, whether severally or individually, from extending any loan facility howsoever called or described) to the Government of Abia State pending the hearing and determination of the Motion on Notice filed herein.” Meanwhile, the court has adjourned the matter to April 5, 2023 for hearing on Motion on Notice. The country’s National Authority for Personal Data Protection said there were privacy concerns relating to the model, which was created by US start-up OpenAI backed by Microsoft. The regulator said it would ban and investigate OpenAI with immediate effect to find out whether it complied with General Data Protection Regulation (GDPR) which governs the way in which businesses can use, process, and store personal data. The body also disclosed that ChatGPT had “suffered a data breach on March 20 concerning users’ conversations and payment information of subscribers to the paid service”. Other ChatGPT flaws cited The Italian data protection watchdog said there was no legal basis to justify “the mass collection and storage of personal data for the purpose of ‘training’ the algorithms underlying the operation of the platform”. It also said that since there was no way to verify the age of users, the app “exposes minors to absolutely unsuitable answers compared to their degree of development and awareness”. The data protection body is asking OpenAI to “communicate within 20 days the measures undertaken” to remedy this situation – or risk a fine of up to 4% of its annual worldwide turnover. Since it launched in November 2022, millions of people all over the world have used ChatGPT. The AI tool can answer questions using natural, human-like language and it can also mimic other writing styles, using the internet as it was in 2021 as its database. ChatGPT can also be used to write computer code, without having the technical knowledge. To leverage the popularity of the tool, software giant, Microsoft has invested billions of dollars in OpenAI and has integrated ChatGPT to its Bing and Edge browser last month. It has also said that it will embed a version of the technology in its Office apps, including Word, Excel, PowerPoint and Outlook. Meanwhile, there have been concerns over the potential risks of artificial intelligence (AI), including its threat to jobs and the spreading of misinformation and bias. In an Exposure Draft of the Regulatory Framework for Agent Banking in Nigeria, the CBN said mobile agents are barred from using merchants’ Point of Sale (PoS) terminals in the course of their operation. According to the central bank, agents should avoid using the wrong option for transactions such as the use of the purchase option on PoS Terminals for cash-in and cash-out transactions. Also, the financial regulator restricted the PoS agents from performing foreign currency transactions, opening accounts or disbursing loans to their customers. “An agent shall not accept deposit or allow withdrawal above an amount which shall be prescribed, from time to time by the bank. “Use the wrong option for transactions e.g agents shall not use the purchase option PoS Terminals for cash in and cash out transactions,” the circular signed by Musa I. Jimoh, Director, Payments System Management Department reads. Also listed among services mobile banking agents are barred from offering are “Open accounts, grant loans or carry out any appraisal function for purposes of opening an account or granting of a loan or any other facility except as may be permitted by any other written law to which the agent is subject. “Undertake cheque deposit and encashment of cheques. Accept deposit or allow withdrawal above an amount which shall be prescribed, from time to time, by the bank. “The agent bank employee also should not be a staff of financial institution and also provide cash advances,” the central bank stated. The CBN adopted the use of PoS agents to move banking closer to underserved areas across Nigeria and deepen financial inclusion. PoS agents have saturated the country, with many Nigerians now patronising them for cash withdrawals, cash transfers and certain bill payments, instead of visiting commercial banks. This prompted the need to reiterate the activities of the mobile banking agents, “This has necessitated the review of agent banking regulations to streamline activities in agent banking while ensuring that appropriate risk mitigation measures are taken by stakeholders”, it said. The NRC train was involved in an accident with a Lagos State Government staff bus on the rail track in the Sogunle area of Lagos. Two bodies have so far been recovered from the scene, while several others are injured, according to the National Emergency Management Agency. Okhiria told the News Agency of Nigeria in Lagos: “According to the information I gathered at the scene of the incident, they said many cars stopped when they got to the level crossing while the Lagos State Staff Bus driver continued moving, which I don’t know why. “Maybe the driver thought he could pass before the train got nearer to him. He could not pass, and then the train crushed the bus; that is what we gathered. “The train was coming from Ijoko to Iddo,” He urged Lagos drivers to be more careful when passing through the level crossing, to avoid train accidents. The managing director, who was concerned about the lives of the Lagos State staff, appealed to motorists to consider the level crossing at all times. Okhiria said that when motorists get to the level crossing, they should not ignore the point where they should stop. The Director, of Public Affairs and Enlightenment Department, Lagos State Traffic Management Authority (LASTMA), Mr. Taofiq, Adebayo, had said in a statement that a Lagos State Government staff bus was crushed by a moving train at PWD, Ikeja. Adebayo said that the staff bus was with registration no 04A- 48LA, He said that the enforcement officers of LASTMA were the first emergency responders at the scene of the accident. ByQosim Suleiman March 9, 2023 Reading Time: 4 mins read The Independent National Electoral Commission (INEC) has postponed the governorship and state houses of assembly elections by one week. The elections arlier scheduled for Saturday 11 March will now hold on Saturday 18 March, the commission said in a statement by its spokesperson, Festus Okoye, on Wednesday night. The first round of the elections – the presidential and national assembly elections – held as scheduled on 25th February. The statement said the postponement was to make for adequate timing to reconfigure the Bimodal Voter Accreditation System (BVAS) ahead of the governorship and state assembly polls. The Presidential Election Tribunal had restrained the commission from tampering with all sensitive materials –including the BVAS – used in the conduct of the presidential election following the request by the the candidates of the Peoples Democratic Party (PDP) and the Labour Party (LP), Atiku Abubakar and Peter Obi, respectively, who rejected the outcome of the presidential election. The opposition candidates, who came second and third respectively, rejected the emergence of the All Progressives Congress (APC) candidate, Bola Tinubu, as winner of the election and called for the conduct of another round of elections or be declared the winner. In preparation of a suit to challenge the outcome, they approached the court seeking permission to inspect all sensitive materials and restrain INEC from tampering with them. While INEC approached the court on Monday to seek permission to reconfigure the BVAS, the request was only granted on Wednesday, two days to the initial date of the governorship election. “While the ruling of the Tribunal makes it possible for the Commission to commence the preparation of the BVAS for the Governorship and State Assembly elections, it has come far too late for the reconfiguration to be concluded,” Mr Okoye said in Wednesday’s statement. “Consequently, the Commission has taken the difficult but necessary decision to reschedule the Governorship and State Assembly elections which will now take place on Saturday 18th March 2023. By this decision, campaigns will continue until midnight of Thursday 16th March 2023 i.e. 24 hours before the new date for the election.” INEC said the decision was taken to ensure that there is adequate time to back up the data stored on the over 176,000 BVAS machines from the Presidential and National Assembly elections “and then to reconfigure them for the Governorship and State Assembly elections.” The commission, however, stated that it is not against any litigants inspecting the election materials, promising to grant them all the access they require to pursue their cases in court. “However, we wish to reiterate that the Commission is not against litigants inspecting election materials. Consequently, it will continue to grant all litigants access to the materials they require to pursue their cases in court. “We wish to reassure all political parties and candidates that the data from the Presidential and National Assembly elections will be backed up and available in INEC cloud facilities, including the INEC Results Viewing Portal (IReV). Political parties can apply for Certified True Copies of the backend data of the BVAS. Also, the results on the BVAS will continue to be available on the IReV for interested parties to access.” But for the latest postponement, the 2023 general election would have gone down in history as the first election held as scheduled since 2015. Nairametrics gathered that the alleged stolen funds transferred across banks is being traced up to the 5th recipient, most of whom received payment for rendering legitimate services and had no knowledge of the said fraud. As of the time of filing this report, some customers of Access Bank, GTBank, FCMB, Stanbic IBTC, Providus Bank, Union Bank, Sterling Bank, and Fidelity Bank, among others, have confirmed that their accounts have been frozen in connection to the fraud. Bank customers who have been reacting to Flutterwave’s denial of the fraud expressed shock that messages from their respective banks confirmed that their accounts were being frozen on the orders of Flutterwave. Customers query denial: Reacting to Flutterwave’s insistence that its system was not hacked and that no customer lost money, a bank customer whose 3 bank accounts have been frozen, Gbadamosi Muyideen, said: “3 of my bank accounts with Access, Providus, and FCMB have been frozen in connection with the Flutterwave hack. My account officers from the three banks told me that flutterwave requests my accounts be frozen and that I received fraudulent money from Flutterwave hack proceeds. They went as far as freezing accounts up to the 5th beneficiary. “How come they are denying the hack? I provided the service for the fund I received from my customers through Flutterwave. And the worst part is that all the people I paid through the 3 accounts have been on my neck because they can’t go about their daily business due to this. “Now I’m completely heartbroken, stranded, and feel like ending it once and for all because I can’t do business now and I can’t finance my daily needs.” Also reacting to Flutterwave’s denial via a Twitter post, another bank customer, whose account has been frozen, Ufedo David, said his bank contacted him and that his account has been placed on hold, citing a petition from Fluttwerwave’s lawyer. A screenshot of an email from Stanbic IBTC to Ufedo, dated February 15, 2023, reads: “Dear Mr Ufedo, “Kindly note that we received a request from Flutterwave for an unauthorized debit to the tune of N7,098,468 on 6th February 2023. The Fraud Desk team placed a hold and sent a mail across to gain knowledge about the purpose of inflow. We have provided feedback received to Flutterwave and await a response.” Directing his anger at his bank, an Access Bank customer, Adeyemi Adeniyi, whose account was also frozen in connection with the fraud, tweeted this: “@accessbank_help, why have you refused to remove the lien on my bank account even after I have provided all the required documents you requested for? I have no business with @theflutterwave and their account being hacked. How does it affect me?” What Flutterwave said: While the action on several accounts that had received money from Flutterwave in recent times suggested otherwise, the company had insisted that it was not hacked. “During a routine check of our transaction monitoring system, we identified an unusual trend of transactions on some users’ profiles. INEC Chairman and Returning Officer for the presidential election, Mahmood Yakubu, on Wednesday, declared the candidate of the All Progressives Congress (APC), Bola Tinubu, as the winner of the elections, having polled the majority votes of 8,794,726. Confirming the incident in a statement on Monday, Feb. 27, the Police Public Relations Officer, PPRO, SP Abdullahi Kiyawa, said that a group of suspected thugs set the office ablaze with two unidentified persons in a stationary vehicle inside the building burnt to death. The Kano State Police Command said it received reports of the incident around 4 pm during the collation of results at the INEC office in Tudun Wada Local Government Area. According to Kiyawa, the hoodlums also mobilised and attempted to block the road leading to the INEC office. “Security personnel were immediately mobilised to the scene,” the PPRO said. “One of the thugs was fatally injured and was rushed to Hospital where he died while receiving treatment. Although Mr Tinubu, a former governor of the state, has won more local government areas, he is trailing behind Mr Obi by a slim margin of 1,686 votes. While Mr Tinubu has triumphed in 10 local government areas, polling a total of 447,192 votes so far, Mr Obi is ahead in only seven local governments, but is leading the tally narrowly with 448,878 votes. PREMIUM TIMES is on ground at the Lagos State Collation Centre for the Presidential Election. The newspaper had reported how Mr Tinubu was narrowly leading the tally after the results had been declared in 12 local government areas. But with results declared in more local government areas, Mr Obi caught up with him and subsequently overtook him. The other two front-runners in the election – Atiku Abubakar of the Peoples Democratic Party (PDP) and Rabiu Kwawanso of the New Nigeria Peoples Party (NNPP) – have yet to win any local government area in the state. While Atiku has polled 60,330 across the 17 local government areas where results have been declared so far, Kwankwaso has scored 6,870. The 10 local government areas where Mr Tinubu has triumphed are Agege, Apapa, Badagry, Epe, Ibeju-Lekki, Ifako-Ijaiye, Ikorodu, Lagos Island, Lagos Mainland, and Surulere. Aluko, who was speaking on Channels Television’s The 2023 Verdict on Friday evening, said the commission had not reviewed its position, describing as fake news, reports that people could approach the polling units without their voter cards. “INEC has not reviewed that slogan. No PVC, no voting. It still subsists. And we have been drumming into the ears of Nigerians, that they should please ignore these social media posts that are circulating everywhere. Today, when our chairman was responding, he just said it’s fake news. And of course, there are a lot of fake news around today. “At election periods like these, we should let Nigerians have the facts, the basic facts, so that it would help their participation. If you do not have the PVC, you cannot even come to our polling units. The election officials will not allow you to join the queue. And if you want to forcefully come into the place, the Presiding Officer will inform the security agencies to deal with the person. "So, it is good that we deal with the facts, it is good that we follow what INEC has said, rather than what some fake INEC officials are saying. No PVC, no voting. PVC is at the centre of our operations.” Aluko also said that the commission was expecting only the 87.2 million voters who had their PVCs at the polls, adding that those who could not get the cards, would have to wait to vote at the next elections cycle. “87.2 million Nigerians have PVCs, out of 93.4 million registered voters. Those are the people we are expecting in our polling units. Anybody who was not able to collect the PVC, it is not a crime. In future, they can still collect their PVCs and vote, life continues, there will be life after these elections. “During the CVR, we encouraged those who lost their cards, even those whose cards were spoilt, just tell us in INEC, we will give you another one free of charge. So, those who did so, got new cards. Anybody who did not do so, did not want to do, and so in future they can still do that. “If out of the 87.2 million Nigerians who have PVCs, if we can get 80% of them to vote tomorrow, that will be a great thing for the country. Enhanced services: Akintoye revealed that the service would be fully run and powered by the Bullnet platform and was developed to cushion the pains of the naira redesign which has caused a cash scarcity in the country, he added: “The CBN has collaborated with ChamsMobile Ltd., CBN licensed mobile money operator and Super Agents to address challenges faced primarily by the unbanked, the underserved and those on the other side of the digital divide by developing the service known as eNaira enhanced services, where the eNaira USSD channel *997*50# can be used to carry out all banking transactions. “This wallet can be funded directly using this platform with cash-purchased vouchers like GSM recharge cards or from a funded bank account using bank cards via the web portal that has been provided or using electronic payments with any authorised agents.” No bank account needed: He added that the service also enables users to send eNaira directly from their wallets to an ATM and withdraw the cash equivalent without the need for a bank account, he said: “Users can also transfer eNaira from one wallet to another simply by putting in the recipient’s phone number. “This service also makes it possible for users to cash out by sending the eNaira directly from their wallets to an ATM and withdrawing the cash equivalent without the need for a bank account or bank card “The users can also send eNaira to a designated account for savings or further transactions.’’ Akintoye stated that it would also work with a network of Banking agents in Nigeria including Chamsmobile, Super Agents and other mobile money agents, and POS agents among others, who would sell eNaira vouchers to customers at a profit as well as onboarding new users. He said the eNaira extension workers can buy and register SIMs and help customers that don’t have phones already to operate their wallets, even on their phones in case the customers are not able to buy their own phones. They can help them to keep physical ledgers for eNaira transactions in places, where there are no mobile services or network.” What you should know The Central Bank of Nigeria revealed last December that the circulation of the e-naira had risen to N401.82 million as transaction volume rises from over N4 billion to N5 billion. Hajiya Rakiya Mohammed, Director of Information and Technology at the CBN noted that the CBN prides the e-naira on being peer-to-peer, hence, no charges for now. She also disclosed that the financial system is big enough to accommodate everyone. “E-naira is easy to onboard, get it, fund it, use it, anyone can be on board with it. In Nigeria, we have had several drivers for IT growth; inclusive payment is a rallying driver for the CBN,” she said. Read More Also, 63 individuals have been arrested by men of the Nigerian Security and Civil Defence Corps (NSCDC) after political clashes along Zaria road in Kano city. The Spokesman of the Civil Defence Corp, Ibrahim Idris Abdullahi told reporters that the arrested persons were caught wielding dangerous weapons and this led to the burning of many cars and smashing of glasses. Abdullahi said: “We have arrested about 63 suspected thugs disrupting public peace, wielding dangerous weapons, burning vehicles and snatching handsets from people.They are going to be investigated and taken to court for prosecution” he stated. It was gathered that the seven persons were killed along Zaria road during the clash with political thugs. An eye witness told THISDAY that one of the persons killed was burnt to ashes after he was said to have killed three persons. Several other people are confirmed to have been injured as a result of the clash before the arrival of the security operatives. Unconfirmed sources told reporters that some local government officials and party members were said to have been arrested but no official confirmation from either the government or the police in the state as of the of filing this report. Reacting to the incident, an APC chieftain and Deputy spokes person of Gawuna/Garo Campaign Council, debunked the allegations that APC members were involved in clash. Ekpa, a self-acclaimed disciple of the detained leader of the Indigenous People of Biafra, Nnamdi Kanu, had repeatedly ordered the people of the South-East to observe a sit-at-home and asked them to boycott the general election billed for Saturday. His repeated sit-at-home orders broadcast via social media are believed to be responsible for the orgy of bloodshed and destruction of lives and property in the region by its enforcers. Simon Ekpa, a Nigerian-Finnish lawyer, political activist and former athlete, was born on March 21, 1985 in Ohaukwu Local Government Area of Ebonyi State. 2.
